On June 19th, the Office of the US Trade Representative (USTR) issued an announcement to officially launch the $200 million tax list product exclusion process.

200 billion product exclusion requests can be submitted via the web channel. The website will be launched on June 30, 2019. The application deadline is September 30, 2019. Comments on a product exclusion request should be submitted within 14 days of the application being posted on the USTR website. Any rebuttal to this comment should be submitted within 7 days of the expiration of the 14-day comment submission deadline, or within 7 days of the posting of the comment on the web.

The $200 billion tax collection list was officially implemented on September 24, 2018, initially at a 10% tax rate. On May 10, 2019, the tax rate imposed was increased to 25%. The opening of this product exclusion channel is an important opportunity for companies to reduce the impact of tariffs through US law procedures. Product exclusion applications should be submitted by US entities. All exporting companies in China can get in touch with US importers or brand owners and invite them to participate actively.

It is worth noting that the effect of the product exclusion decision is retroactive. If it is excluded, the portion of the tariff imposed on September 24, 2018, will be refunded. Some of the current $34 billion taxation plan and $16 billion taxation plan have been approved by the US.
